Seter & Vander Wall, P.C. Announces Personnel Changes. Kathy Glover retired as firm administrator after more than twenty years with Seter & Vander Wall. The Firm celebrated at Seasons 52 with family, friends, colleagues, and former colleagues. The Firm wishes her well in this next chapter. Kathy will be missed by all!

The Firm welcomed Carolyn Jeffrey as new firm administrator. She was the office manager at a similar size law firm for over six years and has an extensive career in event planning.

Seter & Vander Wall, P.C. Welcomes New Associate, Cameron Richards. The attorneys and staff at Seter & Vander Wall are pleased to welcome Cameron J. Richards, Esq. to the firm. Cameron earned his Juris Doctorate from University of Denver’s Sturm College of Law in 2012, and a Bachelor of Arts in History from Ohio Wesleyan University in 2003, where he was a member of Phi Alpha Theta, the History Honor Society, and worked for the Book Review section of The Historian.  Following law school, Mr. Richards focused on civil litigation and workers’ compensation defense.  Mr. Richards currently practices in the areas of special district representation, land use, real estate development and associated litigation.

Seter & Vander Wall Continues Support of Friends of Levitt Pavilion Denver. The firm is proud to once again provide sponsorship of the Friends of Levitt Pavilion Denver. Associate Colin Mielke serves as President of the Board of Directors for the organization. Levitt Pavilion Denver is a public/private partnership between the City and County of Denver & Levitt Pavilion Denver, and will be operated by Friends of Levitt Pavilion Denver, a Colorado non-profit with a mission to build community through music by creating an outdoor amphitheater in Ruby Hill Park, located adjacent to the South Platte River greenbelt. Levitt Pavilion Denver has an anticipated opening date of July 2017.

Seter & Vander Wall, P.C. Sponsors the Barristers Benefit Ball for the Metro Volunteer Lawyers. For the second consecutive year, Seter & Vander Wall P.C. sponsored the Barristers Benefit Ball to support the Metro Volunteer Lawyers (“MVL”). MVL is the pro bono arm of the Denver Bar Association, providing civil legal services to those in need in the Denver metropolitan area. MVL’s mission is to “bridge the gap in access to justice by coordinating the provision of pro bono legal services by volunteer lawyers within the Denver metro area to people who could not otherwise afford legal services for their civil legal issues.” Elizabeth Dauer volunteered her time to MVL for planning the Barristers Benefit Ball, and served as the chairperson for raffle ticket sales.

Seter & Vander Wall P.C. to Expand Current Office Space. Seter & Vander Wall, P.C. is expanding its current office space at the Solarium building in Greenwood Village! Following the expansion and office space update, the firm, its clients and visitors will enjoy a larger, state of the art conference room and other enhancements in the same convenient location at Orchard Road and Quebec Street in the Tech Center.

Seter & Vander Wall, P.C. Welcomes Russell Newton. Seter & Vander Wall welcomed Russell Newton, Esq. to the firm. Russ earned his Juris Doctorate degree from the University of Oregon School of Law in 2011 and graduated from the University of Colorado Boulder with Bachelor of Arts degrees in Political Science and Economics in 2006. Following law school, Mr. Newton earned a Master of Business Administration from the University of Colorado Denver Business School in 2014. Mr. Newton has experience working as a contract attorney within various practice areas, including construction defect, business transactions, and trademark law. Mr. Newton’s practice includes litigation assistance for special districts and municipalities.

Seter & Vander Wall’s attorneys and paralegal participated in the annual Special District Association conference in Keystone, Colorado, making it the 13th consecutive year that Seter & Vander Wall has participated in or presented at the conference.

Kim Seter and Elizabeth Dauer lead a discussion at the SDA Conference Library District Forum, along with the Director of the Elbert County Library District and the President of the Colorado Association of Libraries.

Colin Mielke and Jen Wascak presented “A Tax in Fee’s Clothing – Preventing Litigation Over Your District’s Fees and Taxes,” a discussion on the differences between special district fees and taxes, and why boards of directors need to know the difference. The presentation included topics such as: 1) Identifying how the problem of imposing a tax as a fee arises; 2) Discussion of the consequences of imposing a tax, but calling it a fee; 3) Providing a “cheat sheet” of solutions to ensure boards of directors correctly identify proposed fees and taxes, and the proper steps to implement each.

Seter & Vander Wall, P.C. Helps Pass Ballot Question for Central Clear Creek Sanitation District. The Central Clear Creek Sanitation District passed a ballot question at the May 2014 election approving the issuance and repayment of bonds for needed improvements and upgrades to its sewer treatment plant. Prior to hiring Seter & Vander Wall, P.C., the District’s attempts to pass the question failed twice. Construction on the improvements is expected to begin in early 2015.

Mr. Seter presented the argument to the justices on behalf of its client, Pivotal Parker Commercial, LLC, in the case of SDI, Inc. v. Pivotal Parker Commercial, LLC, case no. 2012SC870 regarding the delegation of governmental power to private parties and the potential effects on public financing.

Jacqueline C. Murphy Leads Workshop at Colorado Association of Libraries Annual Conference. Jacqueline C. Murphy, along with Shelly Walchak from the Colorado State Library, lead a workshop entitled “Trustee Policy Workshop: Hands on Exercises in Writing Clear, Effective Policies.” Through this workshop, Ms. Murphy provided library trustees with expert guidance on how to create policies that will help the library run smoothly.

Seter & Vander Wall, P.C. Victorious at Colorado Court of Appeals. Attorneys Kim J. Seter and Jeffrey E. Erb were victorious in their appeal to the Colorado Court of Appeals in the case of SDI, Inc. v. Pivotal Parker Commercial, LLC, ___292 P.3d 1165___ (Colo. App. 2012) (Case No. 11 CA 0134). Mr. Seter and Mr. Erb successfully argued that a special district cannot assign its legislative power to set development fees to private parties and that any such delegation, including the ability to charge interest on the development fees, was void. Further, the Court of Appeals concluded that the statutory perpetual lien created by statute in favor of a special district cannot be assigned to a private party. As a result of this ruling, Mr. Seter and Mr. Erb’s client realized a significant increase in the value of the real estate that was the subject of this lawsuit.

Seter & Vander Wall, P.C. Achieves Dismissal of Case Against Library. Seter & Vander Wall, P.C. attorneys Kim J. Seter, Jacqueline C. Murphy, and Jeffrey E. Erb successfully defeated all claims against their client in JM Fay v. Arapahoe Library District. The district court judge granted the Library’s motions for summary judgment on each claim raised by the plaintiff, including: (1) library service is not a state or local public benefit that requires the patron to provide a secure and verifiable form of identification; and (2) the library district’s Board of Trustees has the discretion to allow nonresidents of the library district to use library materials and equipment as well as other library resources, including meeting rooms, study rooms, and other library programs.

Erb to the Citizen’s Advisory Committee.
